1. Acceptance of Terms
By accessing or using the Nami Japanese Academy platform ("Platform", "Service"), you agree to be bound by these Terms of Service ("Terms"). The Platform is intended strictly for users located in Singapore. If you do not agree to these Terms, you must not use the Service.
2. Nature of the Platform
The Platform is a lesson management and administrative system operated by Nami Japanese Academy to:
- Manage students and teachers
- Schedule lessons and track attendance
- Manage lesson credits and invoices
- Send operational notifications via WhatsApp
- Integrate with Google Calendar
The Platform does not itself provide Japanese language instruction. All instruction is provided by teachers engaged by the Academy.
3. User Roles
3.1 Owner (Academy Administrator)
The Owner is responsible for:
- Student and teacher onboarding
- Lesson scheduling rules
- Pricing, lesson packages, and invoices
- Business hours and notification settings
3.2 Teachers
Teachers:
- Have restricted access limited to teaching and scheduling functions
- Are responsible for marking attendance accurately
- Are not employees of the Platform
3.3 Students
Students:
- Have restricted access limited to invoice and scheduling functions
- Attend lessons scheduled via the Platform
- Use lesson credits purchased from the Academy
- May request rescheduling subject to policy and approval
- Are responsible for timely payment of invoices
4. Accounts and Authentication
Authentication is performed via One-Time Passwords (OTP) sent by WhatsApp or email. Users are responsible for safeguarding access to their devices and accounts. OTPs must not be shared with any other person.
5. Lessons, Credits, and Attendance
5.1 Credit Validity (2-Year Expiry)
All lesson credits are valid for two (2) years from the invoice issuance date, unless otherwise stated in writing.
Upon expiry:
- Unused credits automatically expire
- Expired credits are forfeited
- Expired credits cannot be refunded, extended, reinstated, transferred, or exchanged
5.2 Attendance and Credit Deduction
Lesson credits are deducted when a student attends a lesson and is marked "present", or when a lesson is forfeited. Attendance records maintained on the Platform are final and conclusive.
5.3 Rescheduling and Cancellation Policy
Students may submit reschedule or cancellation requests via the Platform.
Any reschedule or cancellation request made less than 24 hours before the scheduled lesson start time will result in the lesson being forfeited.
If a student arrives late for a scheduled lesson, the Platform is not obliged to extend or reschedule the lesson. The lesson shall conclude at the originally scheduled end time, and the full lesson credit for the booked duration will be deducted.
A forfeited lesson:
- Is treated as a completed lesson
- Results in full credit deduction
- Is strictly non-refundable
- Is not replaceable, transferable, or extendable
Reschedule requests made more than 24 hours in advance are subject to availability and the Academy's discretion.
6. Invoices, Payments, and Refund Policy
All lesson packages, credits, and payments are strictly non-refundable, non-transferable, or non-extendable. Payments made are final once processed.
No refunds, reversals, chargebacks, or extensions will be provided for:
- Missed lessons
- Late cancellations
- Forfeited lessons
- Expired credits (after 2 years)
- Unused credits
- Suspension or termination of access
7. WhatsApp Communications
By using the Platform, users consent to receiving WhatsApp messages for:
- OTP authentication
- Lesson reminders and join reminders
- Invoice notifications and payment reminders
- Reschedule status updates
These messages are operational and essential to Platform use.
8. Google Calendar Integration
Teachers may optionally connect their Google Calendar:
- Only availability and busy times are accessed
- Personal event details may or may not be disclosed, according to the teachers preference
- Access may be revoked at any time
The Platform is not responsible for Google service outages or sync delays.
9. Acceptable Use
Users must not:
- Use the Platform for unlawful purposes
- Attempt unauthorised access
- Misuse messaging systems
- Disrupt scheduling, records, or system integrity
10. Suspension and Termination
Access to the Platform may be suspended or terminated if:
- These Terms are breached
- Fraud, abuse, or misuse is detected
- Required by Singapore law or authorities
Outstanding payment obligations remain enforceable after termination.
11. Limitation of Liability
To the maximum extent permitted under Singapore law:
- The Platform is provided "as is"
- No liability is accepted for indirect or consequential losses
- No refunds shall be issued except where required by law
- Nami Japanese Academy is not responsible for lesson outcomes, teaching quality, or disputes by teachers
12. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of Singapore.
